These terms are a contract between you and Mocai Inc., a Delaware corporation based in California (“Mocai”, “we”, “us”). By creating an account or using mocai.ai, the Mocai portal, the public API, or the Blender add-on (together, the “Service”), you agree to them. If you use the Service for an organization, you confirm you have authority to bind that organization, and “you” includes it.
Mocai turns ordinary video into 3D motion data: a body mesh, a skeleton, and raw keypoints, reviewable in the browser and exportable in standard formats. Plans are metered in minutes of uploaded footage; what each plan includes is described on the pricing page, which is part of these terms.
You are responsible for the footage you upload. You confirm that you have the rights needed to upload and process it, and that you have obtained any consent required from identifiable people who appear in it. Because Mocai derives body-motion data from video, some jurisdictions' biometric-privacy laws may require specific notice or consent from the people in your footage; obtaining it is your responsibility, not Mocai's.
Don't use the Service to:
API access is included with plans that list it. Keys are secrets; requests made with your keys count against your plan and are your responsibility. Rate limits per plan are published in the docs. We may throttle or suspend keys that exceed limits or show abusive patterns. Webhooks are delivered on a best-effort basis; design your integration to tolerate retries and to poll as a fallback.
Takes are kept for your plan's retention window and then deleted automatically, with advance warning. Export anything you want to keep. We are not liable for content deleted at the end of its retention window, on cancellation, or on account deletion.
The Service itself: the software, models, site design, and everything that isn't your content, belongs to Mocai and its licensors. These terms give you no rights in it beyond using the Service. If you send us feedback, we can use it without obligation.
Blender, Maya, Unity, Unreal Engine, and other tool names are trademarks of their owners. Mocai integrates with them but is not affiliated with or endorsed by them.
The Service is provided as is. Motion reconstruction is probabilistic: output can contain inaccuracies, and results vary with footage quality. Don't rely on the Service for safety-critical, medical, biometric-identification, or legal-evidence purposes. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent the law allows: we are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, data, or goodwill; and our total liability for all claims relating to the Service is limited to the greater of $100 or the amount you paid us in the 12 months before the claim. Some places don't allow certain limitations, so parts of this section may not apply to you.
You will defend and hold Mocai harmless from claims arising out of your content, your failure to obtain consent from people in your footage, or your violation of these terms or the law.
You can stop using the Service and delete your account anytime. We may suspend or terminate accounts that violate these terms, create risk for us or others, or are required to be closed by law; where reasonable, we'll notify you first. Sections that by their nature should survive termination (including 4, 9, and 11 through 16) do.
We may update the Service and these terms. For material changes to the terms we'll give at least 30 days' notice by email or in the Service; continuing to use the Service after they take effect means you accept them. If you don't, cancel before the effective date.
These terms are governed by the laws of the State of California, excluding its conflict of laws rules. Before filing a claim, contact us at info@mocai.ai; most issues resolve fast and informally. Any dispute that doesn't will be brought in the state or federal courts located in California, and both sides consent to their jurisdiction.
